Terms and Conditions
Last updated October 4, 2026
These Terms and Conditions ("Terms") are a legal agreement between you and Spooled LLC, doing business as Bluegill ("Bluegill," "we," "us," or "our"), governing your use of the Bluegill mobile application and fishbluegill.com (together, the "Service").
By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 13 years old to create an account. If you are under 18, you may use the Service only with the involvement of a parent or guardian, who agrees to be bound by these Terms on your behalf.
You are responsible for confirming that you are eligible to participate in any tournament you register for, including meeting age requirements, holding a valid fishing license, and complying with state and local fishing and boating regulations.
2. Your Account
You agree to provide accurate information when you register and to keep it current. You are responsible for keeping your password confidential and for all activity that occurs under your account. Notify us at support@fishbluegill.com if you believe your account has been compromised.
You may not create an account for anyone else, impersonate another person, or maintain multiple accounts to circumvent these Terms or a tournament director's decisions.
3. Anglers and Tournament Directors
The Service has two kinds of users:
Anglers discover clubs, trails, and tournaments, register for events, view results and standings, and communicate with other users.
Tournament Directors create and manage clubs and trails, schedule and run events, approve members, record scores, and communicate with their members. Becoming a tournament director requires submitting an application and being approved by us. We may approve or decline any application at our discretion, and we may revoke tournament director status at any time.
If you are a tournament director, you additionally agree that:
- You are solely responsible for the tournaments you organize, including rules, eligibility, safety, scoring accuracy, prizes, payouts, and compliance with all applicable laws and permits
- You will record results honestly and accurately
- You will handle member information you access through the Service — including names, contact details, and results — only for the purpose of running your organization, and you will not sell it or use it for unrelated marketing
- Any fees you collect are collected by you directly, and you are responsible for refunds, disputes, and any taxes arising from them
4. Bluegill Is a Platform, Not a Tournament Organizer
This is important. Bluegill provides software for organizing and participating in fishing tournaments. We do not organize, host, sanction, supervise, or insure any tournament listed on the Service.
Tournaments are run entirely by independent tournament directors. We are not a party to any agreement between you and a tournament director or between you and another angler. We do not verify the accuracy of event listings, rules, prize claims, or results, and we do not guarantee that any event will take place, that any prize will be awarded, or that any tournament director will honor their commitments.
Any dispute about an event, its rules, its results, its fees, or its prizes is between you and the tournament director.
5. Fees, Dues, and Payments
Bluegill does not currently process payments. Club dues and event entry fees displayed in the Service are records kept for the convenience of tournament directors and their members. Any money changes hands directly between you and your tournament director, outside the Service.
We are not responsible for collecting, holding, refunding, or disputing any payment, and marking dues or fees as paid within the app is a recordkeeping action by a tournament director, not a receipt from us.
6. Safety and Assumption of Risk
Fishing, boating, and tournament participation involve inherent risks, including risk of serious injury or death from drowning, weather, watercraft operation, and equipment failure.
You participate at your own risk. You are responsible for your own safety, the safety of your passengers, the seaworthiness of your vessel, wearing appropriate personal flotation devices, and complying with all boating and fishing laws. Bluegill does not supervise, inspect, or insure any event, vessel, launch, or participant.
Do not use the app while operating a vessel or a vehicle.
7. Your Content
You keep ownership of the content you post, including messages, photos, club and event information, announcements, and results.
By posting content, you grant Bluegill a non-exclusive, worldwide, royalty-free license to host, store, reproduce, and display that content for the purpose of operating and improving the Service. This license ends when you delete the content or your account, except for content others have already received (such as messages) and results that form part of a club's historical records.
You represent that you have the right to post the content you upload, and that it does not infringe anyone else's rights.
8. Acceptable Use
You agree not to:
- Post content that is unlawful, harassing, abusive, threatening, defamatory, obscene, or hateful
- Impersonate any person or organization, or misrepresent your affiliation with one
- Falsify tournament results, weights, or catches, or assist anyone in doing so
- Harass other anglers or tournament directors, or send unsolicited bulk messages
- Upload photographs of other people without their knowledge
- Attempt to access accounts, clubs, or data you are not authorized to access
- Probe, scan, reverse engineer, scrape, or interfere with the Service or its infrastructure
- Use the Service to violate any fishing, boating, gambling, or other applicable law
Bluegill has no tolerance for objectionable content or abusive users. There is no place on the Service for unlawful, harassing, threatening, or hateful content.
If you see that content, report it in the app. You can also block the person, which hides them from your messages immediately and notifies us. We will review reports within 24 hours, remove the offending content, and eject the account responsible.
We may also remove content, suspend accounts, or revoke tournament director status for any other violation of these Terms.
9. Sponsors and Third-Party Links
Clubs and events may display sponsors, offers, and discount codes. Those offers come from the sponsors, not from us. We do not endorse them, verify them, or guarantee that any code will work or any offer will be honored. Your dealings with a sponsor are solely between you and that sponsor.
10. Our Intellectual Property
The Service, including the Bluegill name, logo, software, and design, is owned by Spooled LLC and protected by intellectual property laws. These Terms do not grant you any right to use our trademarks or to copy, modify, or create derivative works from the Service.
11. Termination
You may stop using the Service and delete your account at any time from Settings in the app.
We may suspend or terminate your account if you violate these Terms, if your conduct harms other users or the Service, or if we are required to do so by law. We may also discontinue the Service, in whole or in part, at any time.
Sections 4, 5, 6, 7, 10, and 12 through 15 survive termination.
12. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, secure, or error-free, that results or standings will be accurate, that scoresheet import will read a scoresheet correctly, or that notifications will be delivered. Automated scoresheet reading is a convenience feature and may produce errors; tournament directors are responsible for reviewing results before publishing them.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SPOOLED LLC AND ITS OFFICERS, MEMBERS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, PERSONAL INJURY, OR PROPERTY DAMAGE ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE OR YOUR PARTICIPATION IN ANY TOURNAMENT.
OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS ($100) OR THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE.
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
14. Indemnification
You agree to indemnify and hold harmless Spooled LLC from any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising out of your use of the Service, your content, your participation in or organization of any tournament, or your violation of these Terms or any law.
15. Governing Law and Disputes
These Terms are governed by the laws of the State of Minnesota, without regard to conflict of law principles. You and Bluegill agree that any dispute will be resolved exclusively in the state or federal courts located in Hennepin County, Minnesota, and you consent to their jurisdiction.
16. App Store Terms
You obtained the Bluegill app from the Apple App Store or Google Play. The following applies to the extent you use the Apple version:
- These Terms are between you and Spooled LLC only, not with Apple. Apple is not responsible for the app or its content.
- Apple has no obligation to provide maintenance or support for the app.
- If the app fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price. Apple has no other warranty obligation.
- Apple is not responsible for addressing claims relating to the app, including product liability, legal or regulatory non-compliance, or consumer protection claims.
- Apple is not responsible for investigating or resolving third-party claims that the app infringes intellectual property rights.
- You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government prohibited party list.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
17. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date. If the changes are significant, we will provide notice in the app or by email. Continuing to use the Service after an update means you accept the revised Terms.
